1. Acceptance of Terms

By accessing or using the website of Water Damage Care LLC ("we," "us," or "our"), contacting us, or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or services.

2. Services Provided

Water Damage Care LLC is a licensed general contractor offering water damage mitigation, mold remediation, fire & smoke restoration, storm damage response, biohazard & trauma cleanup, contents pack‑out/pre‑in, reconstruction, repair, and remodeling services. All work is performed subject to a written estimate, scope‑of‑work agreement, and any applicable permits.

3. Estimates and Pricing

All estimates provided by Water Damage Care LLC are free and non‑binding until a formal contract is signed. Pricing is based on the scope of work outlined in the estimate. Unforeseen conditions (hidden mold, structural damage, etc.) may require a revised estimate and change order approved by the customer before additional work proceeds. We reserve the right to withdraw or modify any estimate that has not been accepted within 30 days.

4. Payment Terms

Payment terms will be specified in your project agreement. For most projects, a deposit is required to schedule work, with progress payments due at defined milestones and final payment due upon completion. We accept payment by check, credit card, or bank transfer. Late payments may be subject to a service charge of 1.5% per month or the maximum allowed by law. In the event of non‑payment, you agree to reimburse our reasonable collection costs, including attorney’s fees.

5. Customer Responsibilities

To enable us to perform our services safely and efficiently, you agree to:

  • Provide access to the property at agreed‑upon times.
  • Clear the work area of personal belongings that could be damaged (unless contents pack‑out services have been arranged).
  • Notify us of any known hazards (asbestos, lead paint, etc.) before work begins.
  • Ensure that utilities (water, electricity) are available unless temporary utility solutions are part of the scope.

6. Insurance Claims

When you choose to involve your property insurance, Water Damage Care LLC will cooperate fully with your adjuster. However, you remain directly responsible for payment of all charges. We do not guarantee that your insurance will cover any or all of the work. Any assistance we provide in filing or negotiating a claim is a courtesy and does not constitute a guarantee of coverage.

7. Scheduling and Delays

We strive to begin and complete work within the estimated timeline. However, we are not liable for delays caused by weather, material shortages, permit processing, changes in scope, or other events beyond our reasonable control. In such cases we will communicate revised schedules promptly and work with you to minimize disruption.

8. Warranties and Workmanship

Water Damage Care LLC warrants that all work will be performed in a professional and workmanlike manner consistent with IICRC industry standards. Specific material or equipment warranties are provided by the manufacturer and are passed through to you. This warranty does not cover damage resulting from normal wear and tear, misuse, failure to follow maintenance instructions, or subsequent water or mold events unrelated to our completed work.

9. Limitation of Liability

To the fullest extent permitted by law, Water Damage Care LLC’s liability is limited to the value of the services provided under the relevant project agreement. We are not liable for indirect, incidental, or consequential damages, including loss of use, loss of income, or emotional distress, even if advised of the possibility of such damages.

10. Intellectual Property

All content on this website — text, images, logos, brand names, and graphics — is the property of Water Damage Care LLC or its licensors and is protected by United States copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written permission.

11. Third‑Party Links

Our website may link to third‑party sites (social media, Google Maps, etc.) for your convenience. We do not endorse or control these sites and are not responsible for their content or practices. Access them at your own risk.

12. Termination

Either party may terminate a project agreement with written notice if the other party materially breaches its obligations and fails to cure the breach within 14 days after receiving notice. Termination does not relieve you of the obligation to pay for work performed up to the date of termination.

13. Governing Law

These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any legal action shall be brought in the state or federal courts located in Montgomery County, Maryland.

14. Changes to These Terms

We reserve the right to update these Terms of Service at any time. When we do, we will revise the "Last Updated" date at the top of the page. Continued use of our website or services after any changes constitutes acceptance of the revised terms.
